legal question #2 possible malpractice?
Oct 30 2006 I was accidentally overdosed on dexamethasone – 10 times the dose I was supposed to be on – 15 days – and then they stopped it – put me in shock for 2 days then they put it back up and then tapered me off and I went through withdrawl for quite a long time. it was horrific. but thankfully I survived it. I don’t know if it was near fatal or not but I believe it was. Afterwards I filed a grievance with the nursing board. Apparently the nurse phoned in the prescription to the pharmacy. Both the pharmacist and the nurse both say they did things according to procedure and that the other party made the mistake. and the investigation the nursing board did ruled that a mistake was made but they couldn’t prove who made the mistake. I have until October 30th to file malpractice – but because of how things were done I don’t really know how I am going to prove who made the mistake and who needs to pay –
can anyone advise me?

You sue the hospital or nursing home not the individual that was responsible for the mistake.
Get a good Lawyer…. and no, you don’t have to prove who exactly made the mistake. That is up to the hospital to pursue. It doesn’t change the fact that the mistake was made and that you suffered from it. You were obviously not in any position to even point out who gave you the drugs at the time.
A lawyer might be able to advise you.
A bunch of random strangers on the Internet probably can’t, at least not very well.
