Just wondering because there’s a claim that legal costs are only 1 to 2% of healthcare costs. Let’s assume that number is correct. I don’t know about you but I think that 1 to 2% of 1/7th of the US GPD is A LOT OF MONEY.

We want to sue our child’s doctor for Malpractice. He diagnosed our child with a medical condition that she didnt even have, and put her on medication for it. The medication really messed up our child, causing growth problems, bhavioral problems, etc. Then, months later, the doctor took back the diagnoses and said it was something else!!!!

Of course, we dont go to that doctor anymore, and Malpractice has been brought up. We are seeking legal advice.

However, now the doctor is ‘trying to cover’ his own butt. He said that we, as parents, were causing all the problems! He even accused us of having psychological problems, and called Child Protective Services on us!

I’m not sure what to do anymore! The harder we fight this, the more they make our lives miserable! We are just 2, low-class parents fighting against a doctor, and now Child Protective Services.

We don’t really have any money left, because everytime the doctor or CPS has accused us of something, we have to pay someone else to prove it wrong! (Ex. psychological testing.)

We find it kind of fishy that once we seek legal advice for MalPractice, that the doctor starts all this.

Any advice?

A teenager is rushed to the hospital. They wait all night until she’s admitted next day by 6:00 AM. By 7:00 AM a doctor shows up and determines it’s appendicitis and she has to undergo surgery (appendectomy). Her parents ask for a CT scan to be completely sure. Doctor says it’ll take up to 2-3 hrs before getting the results and the girl needs immediate surgery. He gives instructions to send her to the OR but she waits 7 hrs in her room before she finally enters the OR at 2:30 PM. There is plenty of time to have a CT scan done but it’s not done. Appendectomy goes fine but there is nothing wrong with the appendix. The doctor and hospital try to collect money for this and the girl’s parents refuse to pay. They look for a lawyer but the case is not attractive money wise, so nobody wants to take it. Doctor’s office threatens to send the account to collections. The parents need help. Is there a way to find a legal representation for them or a doctor’s board to report this medical wrong doing

A window on my computer keeps popping up. No matter how many times I click the "X" button, it just comes back 5 minutes later. It says the following:

There is also an icon that randomly appeared on the bottom right hand toolbar on my Desktop. It’s a red circle with a white X in the middle of it. Every so often, a window will appear from it saying: "Click here to protect your computer from spyware. Your computer is infected! Windows has detected an infection of spyware! It is recommended to use special antispyware tools to prevent data loss. Windows will now download and install the most up-to-date antispyware for you.

Do these two windows connect in any way? How do I get it to stop?

What do I do? Please help.

The southern border of my property is being taken by the drinking water/sewer utility company. I have 4 acres, about 1 1/2 acre wide. I knew the city utility was coming when I purchased the property almost two years ago. I am happy about that. However, I was unaware the utility company is going to pay me for my property! They want a 15 ft. wide strip the entire length of my property, which is about 1 1/2 acre long. This works out to a substantial 0.88 acres. Property in my area sells for about 10K an acre.
Who gets the money? Me or the bank holder of my mortgage? Thank you for your help.

My son died of septic shock of unknown cause. He was 30 years old.

I filed a malpractice case against the physicians and the hospital.

I live in Indiana and they have this thing called medical review panel consisting of 3 doctors who decide if doctors and the hospital followed the standards of care.

They ruled that doctors and hospital did not commit malpractice.

My lawyer told me I can still sue in court but chances of winning is low and he will not pursue the case unless I pay money up front.

Is this legal?

Our son was killed in a hospital and unfortunately those responsible are getting away with it. Really need to find help in filing first documents to get ball rolling. Don’t want any money but we must get some kind of justice for our darling boy and we feel we must bring this hospitals screwups into the light of day to protect current and future patients. And yes i have proof just can’t get any lawyer interested not enough possible cash in it for them. Just need pointed in right direction and access to legal documents and filing fees.

I’d get fired if I tested positive, why should taxpayers give money to people who are buying and doing illegal drugs? I’ve got nothing against tax-paying people who smoke pot or do other recreational drugs in moderation, it’s their choice, and it is a private matter. Just like the everyday working Joe that goes out for a beer or two after work, but why should taxpayers have to pay for someone who’s abusing the system? You want your check? We’re going to drug test you. Don’t give me that garbage about personal rights, the government breaks all kinds of laws dealing with privacy and personal rights everyday. If you know up front that you’re going to be drug tested in order to get your federal aide, it’s not an invasion of privacy, it’s a choice. Do you want the help or not?

I have received a letter from the Attorney Grievance stating that the lawyer I had doing my case violated MCR 9.104(A)(2)-(4) and MRPC 1.1(b); and, 1.3. When I was 18 I met with a lawyer about a personal injury case. I was injured in a school in missouri. I had asked the lawyer if there was a cap on how much you could sue a school for and he said NO! He then went on to tell his success on other cases and told me that I should probaly get about 0,000. I had already been offered 3,000 without lawyers. He gave me 2 choices on how to sign a contract. Either he would get 33% of the whole settlement or 50% of over and above what was already offered. If I were to get around the amount he quoted then the 33% contract would give me more money. In the end if he would have known the law I wouldn’t have hired him because I would have gotten more without him. Instead he took advantage of me only being 18 and not knowing the law! Is there any exeptions since I was so young to make him pay. All I want was the money I was intitled to. I have permently disabled from the accident and only recieved ,000, and still have ongoing surgeries. Only serious answers please!!

Please bear with me while I explain the detail.
My father and this guy were suing each other for 70k money. My father hired a law firm to work on the case. Prior to trial, he already paid the firm 17k. The trial opened last week, in county Supreme Court, with Jury and everything. It was going very well on Monday. The opposing party offered 20k settlement, but my dad wanted to go all the way. On Tuesday, during lunch break, the boss of our reperesenting law firm came up to my father and asked him to pay 14k attorney fee right away. My father told him to give him some time to get the money, and the contract gave us a week to pay. The boss insisted we pay him immediately, or he’s going to drop the case and we are going to lose. They had this argument right in front of our opposing party. The argument ended without conclusion. On Wednesday, there was supposed to be a testimony by two opposing party’s witnesses. The law firm didn’t inform us, so we missed it. We found out later that the firm sent a new lawyer who we don’t even know to the court that day (not the one who had been working on our case). On Thursday, my father gave the judge a letter, explaining what had happened, and asked the judge to give him sometime to find another attorney. The judge put the letter into record, and told my father that he has 2 choices: either fire the firm and representing himself, or keep the firm. There is no time to find another attorney. So my father had to choose keeping the firm, since representing by himself has 0 chance of winning. Thursday evening, we went to the firm’s office to prep the case with our old lawyer. In the middle of the preping, the boss came in and literally kicked us out of his office. As a result, we had very little time preparing. In the end, the jury’s verdict was that both parties were award no money.
This leaves my father in a bad situation: he lost the money he should have rightfully won, and he is stuck in a large amount of attorney fee (25k, the law firm claimed). So, what can we do?? At this point, what should be our best course of action? Does this constitue malpractice?

I am a student, and I rented an apartment in Fayetteville, AR, for 5 years. For the majority of my time at this particular apartment, I pre-paid my rent for 6 months to a year in advance. Shortly before I moved, the landlord discovered that there were major errors in the ledgers, and I was told to postpone payment until they could be fixed. After a month and a half of this, I demanded that we try and correct the error. We spoke with their corporate division for around thirty minutes to an hour, and I was given an amount to pay in order to be caught up. After I moved, I contacted the landlord numerous times, and I was told that the books were still a mess and that they were having corporate look into it. Months later, I had still never received my deposit or a list of deductions, and finally after four and a half months, I was referred to a woman at the corporate offices. Finally, my case was passed on to the regional manager, and I began recreating the ledgers with the correct amounts per my records. Today, almost five months to the day, I met with the regional manager, and we went over our versions of what the ledgers should have been line by line. The final verdict was that I had over payed fifty-four dollars, and since my rent had been paid in full, I was also entitled to my security deposit as well as the interest accrued on it over the five years. During my research, I found this at the Arkansas State Legislature website:

18-16-306.Remedies.

(a)(1)If the landlord fails to comply with this subchapter, the tenant may recover:

(A)The property and money due him or her;

(B)Damages in an amount equal to two (2) times the amount wrongfully withheld;

(C)Costs; and

(D)Reasonable attorney’s fees.

(2)However, the landlord shall be liable only for costs and the sum erroneously withheld if the landlord shows by the preponderance of the evidence that his or her noncompliance:

(A)Resulted from an error which occurred despite the existence of procedures reasonably designed to avoid such errors; or

(B)Was based on a good faith dispute as to the amount due.

(b)This section does not preclude the landlord or tenant from any other relief to which either may be lawfully entitled.

The manager and the corporate office was made aware of the errors in the ledger in June/July of 2008. Some of these errors stretch back to when they began using new software (the earliest data we have available) in May of 2005. Once I had moved out, the account was reviewed by someone at the home office, and an amount that I supposedly owed was written off within a week of my move out date. The amount was no where near correct, and it did not actually zero out the balance on the ledger. So, whoever "corrected" the ledger not only knew that the account was still out of balance, but they also never sent me and itemized list of deductions at that point. So based on these facts, I believe that there were either no procedures to prevent these or of errors, or they were not implemented properly. I also believe this was not a "good faith error" because someone reviewed my account and still knew it was not balanced.

So my question is whether I am legally owed double the withheld amount or if I should just take the straight deposit and amount I overpayed without trying to pursue this in court.

I won a judgment against a defendant. My attorney after winning the judgment docketed the judgment on 1/25/07. However he did not act to collect the money as I was told they would do. I tried to explain that I thought rents were attachable since the defendant owned 4 rental properties and was collecting over ,000 a month in rent. After getting frustrated with their non action they released me from their percentage of the judgment so I could collect the money on my own about a month ago. However I have now discovered that in the last few months all 4 of the properties were foreclosed on. Because my attorney simply did not obtain a writ of execution so the rents could be attached, I have not been paid anything from the defendant. Is this legal malpractice?.
Forgot to mention…I asked my attorney for a copy of the agreement, they said they ‘can’t find it’.

The 2008 presidential campaign has shown that the Internet and online videos can have an significant impact on the polls as well as on the results. A candidate who can harness this campaign tool can gather funds and supporters. These online political videos can also be used as weapons for attacking the campaigns of candidates. It’s obvious that any politician who neglects to exploit this tool while have a severe handicap.

I have a ‘77 silver dollar with Eisenhower on it. The back pictures an eagle on the moon, with the earth in the background (a moon landing commemoration?). Anyway, Im just curious, not planning on selling.

To the right Numatist it could be worth a lot.

1) its probably been circulated so worth less.
2) damage to the coin or wear and tear decrease the value.

your best bet at this point is too hold on to it as it will increase in value over time even with it being circulated and having wear and tear.

There are reports that

  1. Israel is planning massive strike on Iranian Nuclear facility with the blessings of United States.
  2. Iran had earlier mentioned that should Israel or US attack Iran, there will be counter attacks on Israel and 32 US bases in Middle East. There could be battery of attacks from Hezbollah in Lebanon and Hamas from Palestine.
  3. Although President Bush has officially denied any support for such operations, his ex-hawks in United Nations Mr. Bolton has indicated such actions are more closer to reality.
  4. There is a growing feeling  that Bush wants to get into the final act of the war before he officially departs on 20th of January, 2009. It will be final act of devastation from the reckless President of United States who will leave a legacy of not only bankrupt banks and economic mess, but also physical blood and body parts flying around.
  5. The attack may take place in next 5 days.
  6. There could be a war between India and Pakistan due to recent non cooperative attitude of Pakistan in dealing with the terrorists. If the war erupts, watch out for the damage on refineries in Gujarat as Pakistani Intelligence strongly dislike Modi, the Chief Minister of Gujarat.
  7. In short, Middle east will be the hot bed of war on multiple front.

Analysis  

Logically, a sitting and departing President is not supposed to get into war gears, but the President Bush, a republican and his War Monger Vice President Mr. Dick Cheney, want to help the war industry as much as they can during final phase before Obama takes over. They want to leave such legacy that President Obama will be left with no choice except to adapt to war and be dictated by what is left behind.

This will be a foreign policy matter which will be managed by another hawk Hillary Clinton. She is in deep debt after losing primary democratic election. It is said that she is in debt in excess of US$ 7 millions. The only way she can mitigate the debt is to appease the War Industry in United States who need desperate orders after sudden calm in Iraq and Obama’s avowed intention to leave Iraq as soon as he can.

There is more logic in above reports. Recent Israeli incursion in Gaza, largest since 1967, was a preparatory exercise and practice ground to launch massive attack on Iran. Israel killed over 800 people and lost only 5, 3 of whom from its own friendly fire, which clearly shows the disproportionate use of force. The attack was also intended to incite Iran into action which may justify the war later on. Iran so far has avoided such instigations.

If the war does erupt, there will be wholesale chaos every where.

1.      Oil prices will suddenly spurt to extremely high level.

2.      Oil Futures for February will be expiring on or about 19 January, so the rise in oil prices will be a distinct possibility.

3.      Gold and Silver may rise, if US$ falls as result. Of course, the forces are at play to prop up the dollar and spread its acceptance as “haven” in the time of war.

4.      Government of India who wanted to reduce oil prices further, may be forced to wait  on such announcement or may make sudden U turn on its proposed policy.

5.      Oil; Producers like ONGC may rise

6.      Refiners may fall due to contraction of their margin again. Reliance Industry may have to prolong the closure of Petrol Pump stations much longer as result.

7.      Government of India may be forced to suspend any announcement on lifting of price control on the petrol.

8.      Fear of inflation amid deflation and recession will rise. Interest rates may also perk up on Libor front

9.      Rupee may weaken by 2% to 3% due to rise in oil bill and lower export revenue due to Satyam saga affecting Software industry. It will be a time to send remittances to India during sudden weakness.

Strategy

1.      To stay away from Air Line stocks for the time being.

2.      to stay away from Auto Stocks of high value. Take this opportunity to build position in Ashok Leyland

3.      Although refiners may suffer, the stocks are so beaten up that this is perhaps last time you may be seeing the lower level. These stocks, especially State Owned Enterprise like HPCL, BPCL and IOC are showing signs of good strength. War related weakness provide good buy opportunity.

4.      To build up the position in Cairns energy slowly. The company may come into production at good time – rising oil prices again. Watch this counter to buy in correction. The company may come into production in June 2009

5.      Gas stocks may rise again. To build up position in Petronet and Gail

6.      Metal stocks may gain due to rise in inflation. Commodities may rise a bit.

7.      Australian currency may also gain due to rise in metal stocks and commodity prices.

8.      Interest rates may not rise due to rise in inflation. Government is in dilemma – to go here or there. That is if they raise interest rates, the recession will deepen, and if they do not do anything, the inflation will raise its head near election.

9.      Major blue chips and finance stocks may go south or lower.

10.  Cash rich companies like HLiver, ITC may do better.

I was told by 3 attorneys that I should file a Malpractice against an attorney, but none would handle it. I tried Attorney Referrals, and Prepaid Legal Services, but their closest one is over 300 miles away. Apparently he has no malpractice insurance, and has put all his assets in his spouse’s name, so there is no money in it for them.
Does anyone know where I can get information to help me handle my own case. I’m willing to pay.
I would appreciate any advice.

I just got certified as a notary public for my job but have no idea what to charge (I got certified so that I can notarize in-house documents, but might as well make some money off it outside of my job). I’m not even sure what to do with it… Any tips/advice?
